\u00bfMensaje tipo comercial v\u00eda correo electr\u00f3nico o mensajes de textos? Quiz\u00e1 la mayor\u00eda… \u00c9sta es una modalidad que resulta muy efectiva a la hora de hacer publicidad, ya que se tiene contacto directo con el receptor del mensaje; sin embargo hacer este tipo de publicidad usando medios digitales puede traer consecuencias muy graves si no se tienen en cuenta las restricciones y leyes en contra de los principios y conductas universales de respeto a la veracidad de la informaci\u00f3n y a los derechos del consumidor.<\/p>\n

Pero se preguntar\u00e1n: \u00bfQui\u00e9n rige todas estas leyes a la hora de hacer publicidad?, Pues por si no lo sab\u00edan existe un c\u00f3digo Colombiano de autorregulaci\u00f3n publicitaria expedido por la CONARP (Comisi\u00f3n Nacional de Autorregulaci\u00f3n Publicitaria) la cual es una disposici\u00f3n deontol\u00f3gica, derivada de la voluntad privada del sector publicitario, que establece las normas y los est\u00e1ndares \u00e9ticos que deben ser observados por los textos emitidos durante los comerciales.<\/p>\n

En esta ocasi\u00f3n haremos \u00e9nfasis en los textos o mensaje comercial que circulan por los medios digitales, el cual podemos encontrar en el Art\u00edculo 8, desde el cap\u00edtulo 47 hasta el 55 del c\u00f3digo mencionado anteriormente.<\/p>\n

El Art\u00edculo 50 de \u00e9ste c\u00f3digo expresa que solamente pueden enviarse un mensaje comercial no solicitados a trav\u00e9s de medios digitales interactivos cuando, adem\u00e1s de respetar las normas aplicables en materia de protecci\u00f3n de datos personales: 1. Existan bases razonables para considerar que el consumidor que los reciba pueda tener inter\u00e9s en el objeto de \u00e9stos o en la oferta; y 2. Incluyan un mecanismo claro y transparente que permita al consumidor expresar su deseo de no recibir otras comunicaciones en el futuro.<\/p>\n
